IMPORTANT INFORMATION
Please take the time to read these terms & conditions carefully. Huckleberry Australia Pty Ltd ABN: 98 111 973 838, Travel Agents Licence No; 3095554 Inbound Tour Operator Licence: 3095555 trading as “Huckleberry Australia”, hereinafter referred to as “HBA,” accepts reservations subject to the following Booking Conditions:
1. VALIDITY
This information listed here within is valid from 2005 to 2006 or until superseded. HBA reserves all rights to update this information accordingly as circumstances and conditions demand.
2. PRICES
All rates are subject to availability, seasonal variations as stated.
3. GOODS AND SERVICES TAX (GST)
All prices are in Australian dollars and are inclusive of Australian GST where applicable.
4. SECURITY DEPOSITS AND FINAL PAYMENTS
A security deposit of $300 per person is payable within 7 days of confirmation of your reservation. You will be notified at the time of your reservation if any additional deposit requirements apply.
Full payment of your holiday is required at least 30 days prior to departure. If for any reason the balance of the full amount is not received by HBA by the due date, we reserve the right to treat your booking as cancelled and to apply the appropriate cancellation charges.
5. LATE BOOKINGS
Bookings made within 30 days of departure will only be accepted if full payment is received by HBA at the time of reservation. For bookings made within 7 days of departure a fee of $50 per person will apply.
6. AMENDMENTS
A minimum service fee of $50 per amendment will apply to each amendment made after booking instructions have been received, plus any fees or charges imposed by the accommodation, service operators or airlines.
7. CANCELLATIONS AND REFUNDS
If you cancel or terminate your holiday we will charge a cancellation fee. The price of your holiday is not guaranteed until full payment is received by HBA.
Prior to final payment: There will be no refund of the $300 security deposit or any additional supplier deposit, where applicable.
After final payment: There will be no refund of the $300 security deposit (Australian GST inclusive). Fees may also be charged by hotels and ground operators up to 100% of the cost.
Refunds: No refund is available for cancellations after the travel or holiday package has commenced or in respect of any tours, accommodation, meals, activities or any other services not utilized.
Document reissue fees: After documents have been issued, a fee of $50 per booking will be charged by HBA in addition to any charges levied by hotels, ground operators. A document reissue means a change to an existing booking and not a transfer to another package wherein cancellation fees may apply.
8. HEALTH AND IMMIGRATION
You should familiarize yourself with any health or visa requirements that may be applicable in the areas you intend visiting. You are responsible for all health and other documents required by laws, regulations, orders, demands or requirements of the countries visited or transited, upon entry and exit and or during your stay in that country. Each person shall carry a valid passport (with at least six months validity) at all times.
9. WHAT IS NOT INCLUDED
Items of a personal and incidental nature such as laundry, drinks, telephone and fax charges, visa and passport fees, vaccinations, meals not specified, gratuities (unless specified), some foreign and domestic arrival/departure taxes, postage and local transport costs at your destination (unless specified as being included as part of the package tour such as transfers).
11. SPECIAL REQUIREMENTS
a) You, the passenger, are responsible for advising us of any special requirements you may have and it is your responsibility to communicate any request for changes or alterations to HBA in writing and at the earliest possible convenience, preferably at the time of making your initial booking.
b) It is your responsibility to advise us in writing of any medical condition that may in any way affect your ability or the ability of any member of your traveling party to undertake the travel arrangements that you have purchased. In addition, you must provide to us a letter from your personal doctor stating the nature of the medical condition and certifying that you are physically fit to undertake the travel arrangements as purchased. It is then your responsibility to provide HBA with copies of the letter and to request in writing that HBA arrange any special requirements considered necessary. Without such written notice, HBA accepts no responsibility for special requirements not provided. Some products in this brochure may require you to undertake medical examinations. You may also be required to show these documents to certain suppliers. Please note that in some circumstances special requests cannot be met after reservations have been made.
2. TRAVEL AND ACCOMODATION
HBA is not itself a carrier, hotelier or car hirer, bus or train operator. The flights, cruises, rail and coach journeys, other travel and hotel accommodation, car hire and any other components included in your holiday are provided by reputable carriers and hoteliers on their own conditions. It is important to note, therefore, that all bookings with HBA are subject to the terms and conditions and limitations of liability imposed by the various service providers involved in your travel booking, some of which limit or exclude liability in respect of death, personal injury, delay and loss or damage to baggage.
13. OUR RESPONSIBILITY
HBA will do its best to make sure your arrangements are satisfactory and we accept liability for, but only to the extent of, any loss or damage sustained by you as a result of our negligence or that of our employees. The standard of accommodation and other services are based on various factors, which are generally accepted as indicative of a certain class; however, we do not guarantee the standard, class, or fitness for purpose of that accommodation or service.
14. LIMIT OF LIABILITY
By accepting the vouchers and tickets and utilizing the services, you agree that neither HBA nor any of its representatives shall be liable to you or any other person for any loss, injury or damage whatsoever to any person or their belongings or otherwise arising out of or in connection with the offer and/or supply of goods or services by HBA or any third parties including but not limited to the supply of accommodation, transportation or other services, resulting directly or indirectly from any occurrences including breakdown/faults in equipment, strikes, theft, delay or cancellations or of changes in itinerary or schedules etc.
We do not accept liability for any injury, damage, loss, delay, additional expenses or inconvenience caused directly or indirectly by any events which are beyond our control including, but not limited to war, civil disturbance, fire, floods, acts of God, acts of Government or of any other authorities, accident to our failure of machinery or equipment or industrial action.
14.CHANGES IN PRICES AND ITINERARIES
All prices are in Australian dollars except where noted. Prices are correct at time of printing and subject to limited availability. Prices are based on tariffs as at 2005.
If we have to change your booking or part of it for reasons beyond our control, we will notify you. If the change or changes result in your holiday costing more or otherwise being materially different from the contemplated prior to the change or changes being affected and in respect of which we have already accepted your deposit or balance payment, you have the right to ask for a rearrangement or to withdraw from the holiday and monies already paid will be refunded less any charges levied by suppliers.
15. TAXES, FUEL SURCHARGES AND LEVIES
Taxes, fuel surcharges and levies are not included in the quoted price, unless otherwise stated.
16. PRODUCT DESCRIPTIONS
Descriptions featured are based on current hotel guide and information provided by hotels and suppliers. Any facilities shown as included are subject to change at any time.
17. MAPS AND PHOTOGRAPHS
Maps are shown for general information and may not necessarily reflect actual routings, locations or services provided. Photographs show places in the geographic areas, but are not necessarily included in the holiday. Hotel room photographs may not be specific to the actual room occupied.
18. TRAVEL INSURANCE
We strongly recommend that at the time of booking, you purchase a comprehensive travel insurance policy of your choice for the period of your intended travel. Ask HBA for details.
19. GOVERNING LAW OF CONTRACT
Any contract or agreements for these holiday packages are deemed to be made in QLD and shall be governed by the laws of QLD. Any disputes or complaints can be made to the QLD office of Fair Trading. This tour brochure is issued on the sole responsibility of the Tour Operator. The airline do not by virtue of their endorsement of products and tours here within this brochure, represent themselves as contracting with any purchaser of a holiday from HBA or as having any other legal relationship with any such purchaser.
Please note that passport, visa and all other health and immigration requirements are your responsibility. HBA cannot accept responsibility for your failure to ensure that you have correct travel information.
